1. Who We Are & What We Provide

805StreetFoods is a platform focused on food truck discovery in California’s 805 region and beyond. The Services include:

• A mobile app and website that help people discover food trucks, events, and venues.
• User features such as favorites, check-ins, badges, ratings, and notifications.
• Vendor and venue tools for managing truck profiles, schedules, photos, and analytics.
• Optional vendor subscriptions and featured placement offerings managed via an external payment website.

2. Eligibility

You may use the Services only if you:

• Are at least 13 years old (or older if required by laws in your region).
• Have the legal capacity to enter into these Terms.
• Use the Services in compliance with these Terms and all applicable laws.

3. Your Account

3.1 Registration & Sign-In

To access certain features, you need to create an account or sign in. 805StreetFoods uses OAuth-only authentication for enhanced security:

• Primary sign-in methods: Sign in with Apple or Sign in with Google
• Email/password accounts: Available by request only. Users cannot create email/password accounts themselves. If you prefer not to use Apple or Google sign-in, contact us at admin@805streetfoods.com to have an account manually created for you.
• No password reset: We do not offer password reset functionality for security reasons. This eliminates password reset attack vectors and credential stuffing exploits.

3.2 Roles & Access

We support different types of users:

• Standard users: Discover trucks, events, and venues; use favorites, check-ins, badges, ratings, and notifications.
• Vendors: Manage truck profiles and schedules, upload photos, and view analytics depending on subscription level.
• Venues: Manage venue information and events where supported.
• Admins: Administrative users with expanded moderation and configuration tools.

Vendor, venue, and admin access may be granted or revoked at our discretion. You agree not to misrepresent your role or attempt to access tools or data that you are not authorized to use.

4. Vendor Subscriptions & Payments

4.1 Overview

Vendor subscriptions (for example, Basic and Pro tiers) and optional featured placement are managed outside of the iOS App Store on our external vendor website (for example, vendor.805streetfoods.com). The mobile app displays your current subscription status and unlocks features based on that status but does not process payments itself.

4.2 External Payment Processing

When you purchase or manage a subscription as a vendor:

• You will be redirected to an external website operated by or for 805StreetFoods.
• Payments are processed by third-party payment processors under their own terms and privacy policies.
• We do not collect or store your full credit card number in the mobile app.

Apple is not responsible for any purchases made outside of the App Store. Any billing questions or disputes related to external subscriptions must be directed to us and/or the payment processor, not Apple.

4.3 Subscription Tiers

We may offer different subscription tiers for vendors (for example, none/free, Basic, Pro) and add-ons like featured placement. The specific features and pricing for each tier are described on the vendor website and may change over time.

Examples of vendor features include, but are not limited to:

• Basic profile editing and event scheduling.
• Photo uploads (logos, banners, galleries) for higher tiers.
• Push notifications and real-time status updates to followers (for eligible tiers).
• Advanced analytics and featured placement options.

4.4 Billing, Renewal & Cancellation

Billing, renewal, and cancellation terms are controlled by the external payment system and presented at the time of purchase. In general:

• Subscriptions may renew automatically at the end of each billing period unless cancelled according to the instructions on the vendor website.
• You are responsible for managing your subscription via the vendor site, including updating payment methods and cancelling if you no longer wish to continue.
• Unless explicitly stated otherwise, fees paid are non-refundable, except where required by law.

4.5 Complimentary Access

We may, at our discretion, grant complimentary or promotional access to certain features or tiers (for example, for beta testers or partners). Complimentary access:

• May be limited in time or functionality.
• Can be revoked at any time without compensation.
• Does not guarantee future free access.

4.6 Featured Placement

Vendors may be able to purchase “featured” or highlighted placement in certain parts of the app or website. Featured placement:

• Is time-limited according to the terms presented on the vendor site.
• Does not guarantee a particular level of traffic or sales.
• May be revoked or paused if content violates these Terms (for example, inappropriate images or misleading information), without a refund unless required by law.

5. User Content & Conduct

5.1 Your Content

“User Content” includes any information, text, images, ratings, notes, schedules, or other material that you submit, upload, or otherwise make available through the Services.

By submitting User Content, you represent and warrant that:

• You have the necessary rights to share that content.
• Your content does not infringe the rights of others or violate any law.

You grant 805StreetFoods a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute your User Content as reasonably necessary to operate and improve the Services (for example, displaying your truck profile and schedule to users).

5.2 Prohibited Content

You agree not to submit content that:

• Is illegal, fraudulent, or misleading.
• Contains hate speech, harassment, or threats.
• Contains explicit or inappropriate imagery unrelated to food or events.
• Violates third-party trademarks, copyrights, or other rights.

We may, but are not obligated to, review and remove content that we believe violates these Terms or applicable law.

5.3 Acceptable Use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the app beyond what is allowed by law.
• Use automated tools (such as bots or scrapers) to access or copy significant portions of the Services.
• Interfere with or disrupt the normal operation of the Services or related systems.
• Attempt to access data or tools (such as admin features) that you are not authorized to use.

6. Intellectual Property

The Services, including text, graphics, logos, icons, and software, are owned by or licensed to 805StreetFoods and are protected by intellectual property laws.

• You may use the Services only as permitted by these Terms.
• You do not obtain any ownership rights in the Services by using them.

7. Privacy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Services, you acknowledge that you have read and understood the Privacy Policy.

8. Third-Party Links & Services

The Services may contain links to third-party websites, apps, or services (for example, vendor payment pages, truck menus, or social media accounts). We do not control and are not responsible for the content or practices of those third parties.

Your use of third-party services is at your own risk and subject to their own terms and policies.

9. Disclaimer of Warranties

The Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.

To the fullest extent permitted by law, we disclaim all warranties, including:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Any warranty that the Services will be uninterrupted, error-free, secure, or meet your requirements.

10. Limitation of Liability

To the fullest extent permitted by law, 805StreetFoods and its affiliates, officers, employees, and agents will not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages, or
• Any loss of profits, revenue, data, or goodwill,

arising out of or in connection with your use of (or inability to use) the Services, even if we have been advised of the possibility of such damages.

Our total liability for any claims arising out of or relating to the Services is limited, to the extent permitted by law, to the greater of (a) the amount you paid to us (if any) for the Services during the 3 months before the claim arose, or (b) USD $50.

11. Indemnification

You agree to indemnify and hold harmless 805StreetFoods and its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to:

• Your use of the Services.
• Your violation of these Terms.
• Your User Content or any content you submit or upload.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe that:

• You have violated these Terms or applicable law, or
• Your use of the Services may cause harm or liability to us, other users, or third parties.

Upon termination, your right to use the Services will immediately cease. Certain provisions of these Terms will survive termination, including ownership, disclaimers, limitations of liability, and indemnification.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last Updated” date at the top of this page and may provide additional notice (for example, inside the app or by email).

Your continued use of the Services after the updated Terms are posted constitutes your acceptance of the changes.

14. Governing Law

These Terms and your use of the Services are governed by the laws of the State of California, USA, without regard to its conflict of law principles.

Any disputes arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the state and federal courts located in California, where permitted by law.
